Fair Use Policy
This Policy forms an integral part of the Terms of Service applicable to all subscribers and users of SkyLink services, including SkyLink Standard and SkyLink Go, provided under the SkyLink pilot program in the Republic of Cabo Verde.
1. Objective and Scope
The objective of this Fair Use Policy (“FUP”) is to ensure equitable access to SkyLink’s limited satellite bandwidth resources, preserve overall service quality, and prevent activities that may compromise network performance or violate applicable laws. All Users agree to adhere to the FUP as a condition of continued access to SkyLink services.
2. Acceptable Use
SkyLink services are intended for personal, residential, or small-business use consistent with normal internet consumption. Acceptable uses include, but are not limited to:
- Web browsing, email, cloud-based services
- Video conferencing and VoIP communications
- Social media and media streaming in SD/HD
- Reasonable file uploads/downloads for non-commercial purposes
Use must be limited to a single household or authorized business entity and may not be resold, redistributed, or shared outside the authorized premises.
3. Prohibited Use
The following uses are strictly prohibited and constitute a breach of this FUP:
3.1 Excessive Consumption and Network Abuse:
- Prolonged high-definition or 4K streaming
- Continuous or automated large file transfers
- Hosting servers or services accessible to the public internet
- Use of the service for bandwidth reselling or distribution to third parties
3.2 Copyright Infringement and Illegal Activity:
- Downloading, uploading, or distributing copyrighted content via BitTorrent, P2P services, or similar mechanisms without proper authorization
- Use of SkyLink’s network for any purpose that violates applicable intellectual property laws, including piracy, unauthorized streaming, or digital content theft
- Circumvention of SkyLink’s technical measures or service restrictions
- Use of the service for any activity prohibited by the laws of the Republic of Cabo Verde or international law
4. Enforcement and Remedies
SkyLink reserves the right to monitor, audit, and investigate usage patterns in order to enforce this FUP. In cases of actual or suspected violations, SkyLink may, without limitation:
- Apply real-time traffic management and deprioritization
- Restrict access to specific high-bandwidth applications or content
- Issue warnings or notices to the User
- Suspend or permanently terminate the User’s service
- Remotely deactivate or recover SkyLink-owned equipment
- Report illegal activity to appropriate governmental or legal authorities
SkyLink shall have sole and absolute discretion in determining whether usage constitutes a violation of this Policy.

5. SkyLink Go Data Allotment
SkyLink Go includes a monthly a set high-speed data allowance. Once the allotment is exhausted, Users must purchase additional data blocks.
- Unused data does not roll over.
- No internet service will be available until a new data block is purchased.
- Service shall resume only upon confirmation of payment.
6. SkyLink Standard Usage and FUP Thresholds
SkyLink Standard does not impose hard data caps but is subject to bandwidth management under this FUP.
- Users with disproportionately high data usage may experience reduced performance during periods of congestion.
- SkyLink may apply dynamic thresholds at its discretion, consistent with the overall capacity of the network and the pilot program structure.

7. Liability and Indemnification
SkyLink disclaims any liability for disruptions or degraded performance caused by enforcement of this Policy. Users found in breach of the FUP may be held liable for damages, costs of recovery, or legal fees arising from non-compliant use.

8. Third Party Fair Use Policy Enforcement
As SkyLink’s satellite internet services are powered by Starlink, all users must also adhere to the Fair Use Policy of Starlink, which governs the underlying infrastructure provided to SkyLink. This policy is binding in addition to the terms stated herein. SkyLink reserves the right to take enforcement actions in accordance with Starlink’s acceptable use and fair use conditions, including bandwidth management, service limitation, or account suspension as required by its service provider.

9. Amendments
SkyLink reserves the right to amend this Fair Use Policy at any time without prior notice. Continued use of the service constitutes acceptance of any modified terms. The latest version will be made available at www.sky-link.space.
10. Governing Law
This Policy shall be governed by the laws of the Republic of Cabo Verde. Any disputes arising from its enforcement shall be subject to the exclusive jurisdiction of the courts of Cabo Verde.
